Your Philippine product registration is still pending: which three things can you do in the meantime? Trademark, label, cost

While a Philippine product registration is pending, start with three things that get more expensive the later you do them: apply for a Philippine trademark in your own name, finalize the label, and check your cost against local shelf prices. Your Philippine product registration is still pending: which three things can you do in the meantime? Trademark, label, cost
Short answer: After a Philippine product registration is filed, do three things while you wait: apply for the trademark in the Philippines in your own name, finalize the label, and check your cost against local shelf prices. Do not ship commercial goods yet.

Scenario: the importer says “it's been filed, now we just wait”

This is a hypothetical scenario, not a story about a specific client.

Your company makes skincare products. Last week your Manila importer wrote: the product notification has been filed with the Philippine FDA, and “now we just wait.”

You feel relieved, and then uneasy. How long is the wait? Should the factory start production in the meantime? Should you start advertising locally? A colleague suggests shipping a batch to the importer's warehouse first, so it can go on the shelf the moment the registration comes through.

The most common mistake during the wait is spending time on things that only matter after the registration arrives, while skipping the things that should be done before it does. Below, first see how long the official wait is, then three things you can do now that get more expensive the later you do them.

First, be clear on how long the official wait is

ItemWho appliesOfficial processing time
Food distributor LTO (initial)The Philippine importer14 working days 1
Food CPR amendment (for example, a brand name change)The importer holding the LTO20 working days 1
Cosmetic CPNA local company holding an LTO that lists a cosmetics activity23 working days and 15 minutes 2

These are the FDA's official processing times. They exclude the time to prepare documents in Taiwan, translate them, and submit corrections, and the LTO must come first before a product registration can be filed 1. In 2026 the FDA moved to a new online system; renewals and amendments of products registered on the old system must be refiled on the new system as initial applications 3, so treat the status your importer sees in the system as the actual progress.

One more rule you cannot skip: each food product needs a CPR before its first import 4. Do not ship commercial goods before the registration comes through.

First thing: apply for the trademark in the Philippines in your own name

In the Philippines, trademark rights come from registration: Section 122 of the Intellectual Property Code states that rights in a mark are acquired through registration made validly under the law 5. A trademark registered in Taiwan does not automatically take effect in the Philippines.

Do this alongside the product registration for one reason: the product registration is already held under the importer's name, and if you also let the importer apply for the trademark, you will have one less card to play when you change partners later. We covered the rules for changing partners in your Philippine product registration is held by the importer: what if you want to switch later?.

Three rules to know first:

  • Apply in your own name, not the importer's.
  • Designate a recipient in the Philippines. An applicant with no domicile or business establishment in the Philippines must designate in writing a person residing in the Philippines to receive notices 5.
  • File a declaration of use within three years. Within three years of the filing date, you must file a declaration of actual use with evidence; if you do not, the application is refused or the mark is removed from the Register 5. So the best time to apply is when you are sure you will launch, which is now.

Second thing: finalize the label instead of changing it after registration

A CPR application for an imported product must include the complete label artwork 1. Changing the packaging after the registration comes through may mean going through an amendment again: in the FDA Citizen's Charter, a brand name change requires authorization from the brand owner, and official processing of an amendment is 20 working days 1.

So the wait is the time to check the label: product name, ingredients, net weight, importer name and address, and how dates are written, checked item by item against the Philippine food and cosmetic label checklist. Place the print order only after the label is final, and do not print a full year's quantity at once.

Third thing: check your cost against local shelf prices

On the day the registration comes through, the first question your importer will ask is: what is your shipping price?

You can work this out while you wait: start from the ex-factory price, add freight, duties, and the importer's and channel's margins to reach the local shelf price, then compare it with the prices of similar products in local supermarkets and e-commerce. Use the method in calculate landed cost before quoting an export price, and look up duties with TradePilot. If the result is much more expensive than similar local products, adjusting pack size or specification now is cheaper than changing it after registration.

If you do not even know the local price range, use this time for a round of market probing: NT$10,000–20,000, to see whether local people will buy and at what price.

What we do not recommend doing while you wait

  • Shipping a batch to a warehouse first. Each food product needs a CPR before its first import 4; without the registration, the goods may not clear customs.
  • Advertising locally first. The product cannot be sold yet, so you cannot handle the inquiries the ads bring in.
  • Letting the importer apply for your trademark in its own name. See the first thing for why.

When we do not recommend following this article

  • Your product does not need FDA registration in the Philippines. There is no waiting period; do the three things right away.
  • Someone else has already applied for your trademark in the Philippines. Talk to a local lawyer first; this is no longer a waiting-period issue.
  • You have not found an importer yet. Then the wait has not started. First read how to export Taiwanese food to the Philippines.

Frequently asked questions

How long does product registration take in the Philippines? The official processing times in the FDA Citizen's Charter are: 14 working days for an initial food distributor LTO, 20 working days for a food CPR amendment 1, and 23 working days and 15 minutes for a cosmetic CPN 2. This excludes document preparation and corrections; the LTO must come first before a product registration can be filed.

Is a trademark registered in Taiwan valid in the Philippines? Not automatically. The Philippine Intellectual Property Code provides that trademark rights are acquired through registration 5, so you must apply separately in the Philippines; an applicant with no domicile or business establishment there must designate a person residing in the Philippines to receive notices 5.

Can I ship before the product registration comes through? We do not recommend it for commercial goods. Each food product in the Philippines needs a CPR before its first import 4. Samples for research or testing require a separate import permit; see the article on exporting Taiwanese food to the Philippines.

One minimal next step

Do one thing today: search your brand name once in the trademark search system of the Intellectual Property Office of the Philippines (IPOPHL) to see whether anyone has applied for it. If not, start looking for a local agent to file; if so, send us one question on LINE.

This article is a summary of experience and practice, not legal advice; for trademark applications, consult a local Philippine agent or lawyer. Last verified: 2026-10-11. The Philippine FDA system is being revamped, so follow current FDA announcements.
